1. Terms and Conditions applicable to the website bigpandafactory.be of Big Panda SRL

These terms and conditions will apply to all transactions made online with Big Panda SRL. Please read them carefully before placing any order. All contracts will be governed and interpreted according to Belgian law, and any dispute between us will be the exclusive jurisdiction of the Belgian courts. Nothing in these terms and conditions shall be deemed to affect your statutory rights. By using this site, you agree to these terms and conditions, and all transactions made with Big Panda SRL will be governed by these same terms and conditions.

Any reference to the "company" or "we" means a reference to Big Panda SRL. Any reference to the "customer" refers to the person or persons who purchase or agree to purchase goods from the company. Any reference to the website includes a reference to all URLs belonging to Big Panda SRL.

2. Prices

All prices are displayed in euros and include VAT at the current rate, unless otherwise clearly and explicitly stated. All prices are subject to change without prior notice. ​

3. Orders

To purchase a product, you must first add the product to your cart. Once you have added the desired products to your cart, you need to enter your contact and billing information. You must then provide us with the necessary payment information for the products. When we have received all the aforementioned information, you will receive a summary page. Acceptance of this page makes your purchase final. The purchase contract can be concluded in the language of the website on which you are making the purchase.

We accept your orders through electronic transactions (secure server). All credit or debit card transactions will be subject to validation checks and authorized by the card issuer. We accept payments via Stripe (Bancontact, Visa, MasterCard, etc.), PayPal, and bank transfer. If your card issuer refuses to authorize the payment, we will not be responsible for any delay in execution or failure to deliver your order. No order will be accepted or processed without a valid payment in the name of the registered holder.

Note : Minors (under 18 years) cannot place an order without parental or guardian permission.

4. Deliveries

All goods are delivered as soon as possible via the transport company Bpost Belgium or by our own delivery services.

All delivery charges are subject to change without prior notice. We strive to ensure delivery within the estimated time frame, with a maximum delay of 30 days from the day following your order. All goods are delivered subject to availability. Promotions are valid for the period indicated or until stocks are exhausted. If we are unable to deliver your goods within 30 days, we will inform you immediately and advise you of the expected delivery date. If we cannot deliver the goods within 30 days, you may cancel the pending orders at any time after receiving the notice of late delivery. If payment has already been made, you will be fully refunded for the affected item(s). 
If any goods delivered by us are damaged during transport, the delivery is incomplete compared to the items listed on the delivery note, or the items do not correspond to those ordered by you, these issues must be notified to us within 14 days of receipt. If we do not receive notification to this effect, the customer will be deemed to have accepted the items as satisfactory. We cannot be held responsible for any loss caused by late delivery or non-delivery by the carrier designated by the company. In such cases, liability is limited to the value of the items whose non-receipt by the customer is proven.

5. Returns and exchanges

We are committed to ensuring that you are entirely satisfied with every purchase made from the website https://www.bigpandafactory.be, and we strive to offer you quality products and service at all times. If you wish to return an item for an exchange or decide not to keep it, please return it at your expense within 14 days with the products in their original packaging, along with the original label. Return shipping costs will not be covered by Big Panda. If applicable, we will exchange or refund the item(s). All goods must be returned to us intact and in new condition, with a copy of your original receipt.

If you wish to return a defective item, please provide details of the defect and return it to us within 14 days with the item in its original packaging. If applicable, we will exchange or refund the item as well as the paid delivery costs. The customer is responsible for sending the goods.

6. Warranty

All products offered are, unless otherwise indicated, guaranteed for a period of 24 months from the date of the original invoice against any defects due to reasonable wear and tear caused by a manufacturing or material defect. The warranty excludes any defects caused by accident, negligence, or misuse. 

In case of a warranty claim, please return the item with a copy of the original electronic receipt to our headquarters at:

Please clearly indicate the location or part that has a defect. All items must be returned in a clean and dry condition, or they will be sent back to you without further attention.

7. Products

Unless otherwise indicated, products are sold individually. Every effort is made to ensure the closest possible match between the colors shown on the website and those of the actual product. Some colors may vary due to technical limitations.

8. Regulations applicable to telemarketing / right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days. 

The withdrawal period expires fourteen days after the day you, or a third party other than the carrier and indicated by you, take physical possession of the last lot or piece. 

To exercise the right of withdrawal, you must notify Big Panda SRL (Rue des Rèlis Namurwès, 29 - 5000 Namur, info@bigpandafactory.be) of your decision to withdraw from this contract by an unambiguous statement (e.g., a letter sent by post or email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. 

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising if you have chosen a delivery method other than the least expensive standard delivery offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, this reimbursement will not incur any fees for you. 

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

9. Force majeure

We cannot be held responsible for the failure to meet our obligations caused by or resulting from labor disputes or any other circumstances beyond the reasonable control of the company, such as accidental events, riots, civil commotions, floods, fires, strikes, lockdowns, difficulty in obtaining transportation, or legislation. If any of these circumstances prevent the company from delivering all or part of the ordered items within a reasonable time, the customer's liability is limited to the value of the supplied items and the associated delivery costs.

10. Content / price and printing Errors

Any information displayed on our website(s) or other materials printed by the company is not authoritative or certified as best practice, and should be considered as helpful supplementary information alongside other certified best practice codes. All information on our website is regularly updated.

Prices and specifications are checked to the best of our abilities, and while every effort has been made to ensure their accuracy, no liability will be accepted for errors and omissions. We reserve the right to modify our prices and specifications without prior notice.

11. Ownership of goods

All items delivered to the customer remain the property of Big Panda SRL until full and final payment of all amounts due for these goods.

12. Claims

Any complaint or compliment can be sent to our headquarters ( info@bigpandafactory.be ).
We will strive to address your claim within 5 business days upon receiving it. In case an immediate solution cannot be provided for your claim, we will inform you of the likely time required to resolve the issue and keep you informed of any investigation.

13. Security

We are fully committed to ensuring complete security for our online service. We utilize SSL (Secure Sockets Layer) technology to safeguard the security of your data in all sales transactions conducted with us. All information you provide to us is fully encrypted to prevent third-party access. (For Internet Explorer, click on the Tools menu, then Internet Options, and finally Advanced. Check the boxes for SSL2 and SSL3. Your browser will confirm that you are shopping in a secure environment by displaying a closed padlock icon or a key in the status bar at the bottom of your screen.)

The content of this site and other publications of bigpandafactory.be is the property owned or licensed to Big Panda SRL or used with permission from the owner. Reproduction strictly prohibited without authorization.

15. Customer reviews

These rules specify the conditions under which you may submit or use a customer review on our website. These rules supplement our website's terms of use and privacy policy and apply to all users of our website. 

By accessing and submitting content on our website, you agree to comply with all the terms and conditions of these rules.

15.a. Guidelines for writing a review

We take pride in ensuring that our customers have all the information they need to make informed decisions about our products. We encourage all customers who have purchased a product to share their experience, while also adhering to these simple guidelines:

Your review should :

    • Reflect your honest opinion.
    • Whether positive or negative.
    • Be precise - state facts.
    • Be coherent - focus on specific product features and your experience with the product.
    • Be concise.

However, your review should not :

    • Be obscene, rude, offensive, or malicious.
    • Be defamatory or constitute harassment towards another person.

15.b. How we might use your customer review

You will retain all copyright rights related to any customer review you submit on our website.

If we determine that a violation of these rules has occurred, we may, at our sole discretion, take these measures if we deem them necessary. Non-compliance with these rules constitutes a substantial breach of the terms of use under which you are authorized to use our website, and may lead us to take one or all of the following measures:

    • Immediate, temporary, or permanent withdrawal of your right to use our website.
    • Immediate, temporary, or permanent removal of any customer review already published on our website.
    • Issuance of a warning to you.
    • Legal proceedings against you to recover all costs (including, without limitation, our reasonable administrative and legal costs) incurred due to the violation.

We disclaim any liability for any actions we may take in response to violations of these rules. The measures described above are not exhaustive, and we may take any other measures that we reasonably deem necessary.

Any customer review or other material posted on our website is provided without any conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies, and third parties with whom we collaborate expressly exclude:

    • All conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity.
    • Any liability for any indirect loss or damage incurred by any user related to our website and any content posted on it, including (without limitation) loss of revenue, profits, data, or business.

These rules do not in any way limit your ability to make claims against us for loss or damage you may suffer as a result of our breach of these rules, nor do they affect our liability for fraudulent misrepresentation or misrepresentation regarding fundamental information, or any other liability that cannot be excluded or limited under applicable law.
